Expatriate Quota is for foreigners who want to embark on a voyage to Nigeria and work, do business or take over a business. Subsequent to a successful application of the expatriate quota in Nigeria, the foreigner becomes certified and eligible to carry on with work or business in Nigeria.

The Immigration Act provides that no person other than a citizen of Nigeria shall accept employment (not being employment with the Federal or State government) without the consent in writing of the Director of Immigration; or either alone or in partnership with any other person, practice a profession or establish or take over any trade or business or register or take over a limited liability company without the consent in writing of the Minister.

THERE ARE TWO TYPES OF EXPATRIATE QUOTA IN NIGERIA

The expatriate quota is categorized into two different types. Each type of Expatriate quota to be applied for depends largely on the nature, relevance and duration of the position to be held by the expatriate.

TEMPORARY EXPATRIATE QUOTA:
This type of expatriate quota is given for the purpose of positions to be occupied by the foreigner for a short period of time.

PERMANENT UNTIL REVIEWED (PUR):
This is granted to companies to enable foreign employees, such as managing director owners of the business to work in Nigeria. As the name implies the expatriate quota is usually for a longer period of time to be reviewed at a much father date.

Expatriate Quota Approval Certificate in Nigeria Required Documents

  1. Completed Immigration Form T/1
  2. Certificate of Incorporation
  3. Minimum Share Capital Requirement – N10million
  4. Memorandum and Article of Association
  5. Joint Ventures and Partnership Agreements( where necessary)
  6. Company’s current Tax Clearance Certificate
  7. Evidence of imported machinery such as Form M, Proforma invoice, Shipping documents and Clean Certificate of Inspection issued by Government appointed Pre-shipping Inspection Agent.
  8. License or Permit or Certificate from relevant Government Agencies for the operation or execution of project for companies that are engaging in oil services, health care services, fishing, mining, constructions etc.
  9. Evidence of work at hand, its duration and value attached to the contract(s) if the company is engaged in building, civil engineer4ing, construction etc. (originals are to be presented for sighting)
  10. Proposed annual salaries to be paid to the expatriates to be recruited. Names, designations, job descriptions and qualifications must also be indicated.

For Renewal of Expatriate Quota

  1. Completed Immigration Form T/2
  2. Corporate Tax Clearance Certificate (original to be presented for sighting)
  3. Current Tax Clearance Certificate of the expatriates (originals are to be presented for sighting)
  4. Expatriate Quota Returns for the three months preceding the date of approval
  5. Detailed Training programmer for Nigerians
  6. List of Nigerians understudying expatriate on prescribed format showing date employed, qualifications etc.
  7. List of Nigerian Senior/Management staff showing names, designations, qualifications, salaries per annum,
  8. Certified Current Audited Accounts
  9. Annual Income Tax clearance Certificate of the Expatriate staff (original to be presented for sighting)

Additional Expatriate Quota

  • Same document as for renewal of expatriate quota plus:
  • Evidence of acquired machinery or expansion if the company is engaged in manufacturing in the form of Clean Certificate of Inspection (CCI) issued by Government appointed Pre-shipping inspection Agents.
  • Evidence of new contract for companies engaging in construction/engineering and oil (original to be presented for sighting)
  • Evidence of acquired farm/factory where the company is engaged in agro-allied business (original to be presented for sighting)
